Terms of use

401k.loans is an independent website ("we", "us"). By using the site you agree to these terms. If you don't agree, please don't use it.

What this site is

401k.loans publishes free calculators and plain-language pages about 401(k) loans, withdrawals, rollovers as business startups (ROBS) and related federal rules. We are not a lender, a loan broker, a retirement plan administrator, a tax preparer or an investment adviser. We don't make loans, take loan applications, quote rates or decide who qualifies, and we're not affiliated with the IRS, the Department of Labor, the SBA or any employer's plan.

Information, not advice

Everything here is general information. It isn't financial, tax, legal or investment advice for your situation, and using the site doesn't create a client, advisory or fiduciary relationship. Your plan document, your tax return and a qualified professional decide what applies to you.

The calculators give estimates

The calculators do arithmetic on the numbers you enter and on dated public figures, each shown with its source (for example the Federal Reserve's published prime rate and average personal loan APR, and the IRS's tax brackets for the year shown). Results are estimates from your inputs, not offers of credit, approvals or predictions. Real rates, fees, taxes and investment returns will differ. Sources and the dates they were checked are on the sources page.

What you send us

If you send the contact form or the business question form, a person on our side reads it and replies by email. We don't pass it to a lender or provider. Please don't send account numbers, Social Security numbers, tax documents or other sensitive details. You confirm that what you send is accurate and yours to send. How we handle it is in our privacy policy.

Acceptable use

Don't use the site to break the law, send spam or harmful code, try to get into parts of it that aren't public, overload it, or collect other people's information. Automated reading for search and AI search indexing is fine as set out in our robots.txt.

Our content and data

The text, design, graphics and calculators on this site belong to 401k.loans. You are welcome to link to any page and to quote short passages with a link back. Please ask before republishing anything more. Federal figures we cite (from the IRS, the Federal Reserve and other agencies) are public; our presentation of them is ours.

Links to other sites

We link to lenders, marketplaces, providers and government sources when they help you check a rule or a real rate. We don't control those sites, a link isn't an endorsement, and we aren't responsible for their content, offers or practices. No one pays us for these links today; if that changes, the link and our how we make money page will say so.

No warranties

The site is provided as it is and as available. We work to keep it accurate and current, but to the extent the law allows we make no warranties, express or implied, including that the content is complete, current or fit for a particular purpose.

Limit of liability

To the extent the law allows, 401k.loans isn't liable for indirect, incidental, special or consequential losses from using the site or relying on its content, and our total liability for any claim about the site is limited to US$100. Some states don't allow these limits, so they may not all apply to you.

Indemnity

If you misuse the site or break these terms and someone brings a claim against us because of it, you agree to cover our reasonable costs of that claim, to the extent the law allows.

Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules.

Disputes

If you have a problem with the site, tell us through the contact form first and give us 30 days to try to resolve it informally. Either of us may bring an individual claim in small-claims court if it qualifies. Otherwise, any dispute about the site will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, and not as a class action or class arbitration. You can opt out of this arbitration and class-action waiver within 30 days of first using the site by sending a "Legal notice" through the contact form with your name and a sentence saying you opt out. Send any other legal notice the same way.

Changes

We may update these terms. The date at the top shows the latest version, and changes apply from that date forward.
